Welcome to Kinnect. These Terms of Service ("Terms") govern your use of the Kinnect care management platform, website, and associated services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

Kinnect provides a software-as-a-service (SaaS) platform designed for care agencies to manage companions, clients, and family communications.

Account Registration: You must provide accurate, complete, and updated information when creating an agency account.
Authorized Users: You are responsible for all activities that occur under your account, including actions taken by companions and administrative staff you invite to the platform.
Acceptable Use: You agree not to misuse the Service or help anyone else do so. This includes attempting to bypass security measures or uploading malicious files.

2. Compliance and Safeguarding

Kinnect provides tools to track safeguarding escalations and Disclosure and Barring Service (DBS) statuses. However, Kinnect is a software provider, not a regulatory body or background check agency.

It is the sole responsibility of the care agency to verify the authenticity of uploaded DBS certificates.
Agencies must ensure they are compliant with all local laws, regulations, and safeguarding frameworks (e.g., CQC in the UK).
Kinnect is not liable for any incidents, damages, or legal repercussions resulting from the actions of companions or the failure of an agency to properly vet its staff.

3. Intellectual Property

The Service and its original content, features, functionality, and design are owned by Kinnect and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

4. Data Ownership

You retain all rights to the data, documents, and information you submit to the Service ("Your Data"). By submitting Your Data, you grant Kinnect a limited license to process and store Your Data solely for the purpose of providing the Service.

5. Limitation of Liability

In no event shall Kinnect, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

6. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
